Booking Conditions

The following terms and conditions (“Terms and Conditions”) apply to all travel and travel related Services or travel arrangements offered for sale by Travelodeal.com. Travelodeal.com is a trading name of Travelodeal Limited. Following booking conditions will form the basis of your contract with us. The term “Service” or “Services” or “Travel arrangements” as used in Terms and conditions encompasses: booking for your flight, accommodation or hotel, resort, transfer, excursion, car rentals, trains, cruises, ferries, motor coaches, or any other travel related services. All references in these conditions to “trip”, “booking”, “contract”, “holiday” or “vacation” mean such travel arrangements or any Service, or package of Services, offered, unless otherwise stated.

We are Travelodeal Limited. The terms "we", "us" , "our" or “Travelodeal”  refer to Travelodeal Limited Our company number is 09061889 , whose registered office address is at 8th Floor, Becket House, 36 Old Jewry, London, EC2R 8DD, United Kingdom. We accepts bookings subject to the following conditions. Except where expressly stated, these conditions only apply to travel arrangements booked by you with us, and which we agree to make, provide or perform (as applicable) as part of our contract with you.

References to “you” and “your” in these terms means you, the traveller or purchaser of travel or all persons named on the booking (including anyone who is added or substituted at a later stage) or any of them. It is your responsibility to read the carefully as they set out respective rights and obligation. By asking us to confirm your booking, we are entitled to assume that you have had the opportunity to read and have read these booking conditions and agree to them.

All bookings of Travelodeal’s are also subject to the Terms and Conditions of the supplier delivering the Services in your travel arrangements.

In these terms, a ‘package’ means the pre-arranged combination of at least two of the following components when sold or offered for sale at an inclusive price and when the service covers a period of more than twenty-four hours or includes overnight accommodation:—(a) transport; (b) accommodation; (c) other tourist services not ancillary to transport or accommodation and accounting for a significant proportion of the package.

You must be of a legal age at the time of booking and possess the legal capacity and authority to act and travel as the lead name on the booking. We will only deal with the lead name on the booking in all correspondence.

A contract will exist as soon as we issue our confirmation invoice. This booking is made on the terms of these booking conditions. Please check all your booking details, including your personal information, before confirming your booking .When you make a booking with us, you guarantee that you have the authority to accept and do accept on behalf of your party the terms of these booking conditions. It may not be possible to make changes to your arrangements later so you should notify us of any inaccuracies in any documentation within 48 hours of our sending it out. It may harm your rights if you don’t.

When making your booking for your travel arrangements, you will be bound by the terms of Suppliers of the travel arrangements named on your booking confirmation along with our booking conditions. The suppliers delivering the services in your arrangements work in accordance with their own terms and conditions which will also form part of your contract with us. Some of these terms and conditions may limit or exclude the supplier's liability to you, usually in accordance with applicable International Conventions. Please note that while we exercise due diligence in the selection of our suppliers, hence we cannot be liable for supplier insolvency or bankruptcy.

By making a booking, you agree on behalf of yourself and those you represent to be bound by all of them. If you are booking for another person you agree to inform that person(s) about the Terms & Conditions that apply to the bookings you have made on their behalf, including all rules and restrictions applicable. Please be aware that these terms and conditions contain waivers of liability as well as waiver of class action and venue selection and notice clauses.

Travel is personal and each individual’s goals and experiences may differ. We will not be bound by, or liable for, any description, photograph, representation or warranty made by or provided by any independent third parties relating to any holiday or vacation or travel arrangements offered by Travelodeal.com.

We both agree that English law (and no other) will apply to your contract and to any dispute, claim or other matter of any description which arises between us. We both also agree that any dispute, claim or other matter of any description (and whether or not involving any personal injury) which arises between us must be dealt with by the Courts of England, Wales, Scotland and Northern Ireland only. You hereby consent to the exclusive jurisdiction and venue of courts in London, United Kingdom, in all disputes arising out of or relating to this agreement.

You will be required to pay us a deposit in accordance with instructions we give you at the time of booking. FINAL PAYMENT IS DUE 80 DAYS PRIOR TO DEPARTURE unless otherwise specified. You will be advised of all deposit details, holiday costs and costs of any additional services in addition to any third-party supplier costs which are either payable in full and/or non-refundable and non-changeable prior to booking. The balance of the price of your travel arrangements must be paid in full no later than the due date shown on your confirmation invoice. However, with any element of your booking, a supplier may ask for full balance payment at an earlier time than Travelodeal’s balance due date (e.g. scheduled airline tickets) and, if this occurs, we will give you as much notice as possible and you will be advised of this possibility prior to booking. The additional amount paid will form part of your non- refundable deposit. If you would prefer, you can look at alternative arrangements rather than make an earlier payment (on the proviso that no cancellation charges would apply), but this could incur extra overall costs. If we do not receive any payment due on time, we reserve the right to treat your booking as cancelled by you in which case the cancellation charges as set out in below sections will apply.

 

You will be notified price of your chosen travel arrangements at the time of booking. The price (may be termed as trip price or total amount of holiday or package price or prices for arrangements anywhere in the conditions), as indicated on your booking confirmation may include a flight as well as applicable airfare taxes, except for some destinations' departure tax. Some countries charge a departure tax at the airport prior to boarding the return flight. This is paid locally and, in some cases, must be paid in local currency.

Other tour services and accommodations are included in your price only if they are indicated on your itinerary. These arrangements inclusions/rates are based on inclusions/prices at time of purchase and are subject to change without notice. You may incur additional expenses that are not included in the price, including but not limited to resort fees, destination taxes and environmental fees. No promise of a discount or refund will be binding on us unless confirmed by us in writing.

 

WE EXPRESSLY RESERVES THE RIGHT TO AMEND ADVERTISED PRICE AT ANY TIME PRIOR TO CONFIRMATION AND CORRECT ERRORS IN THE PRICES OF CONFIRMED HOLIDAYS.

Special Note: We will do our best to ensure that all pricing and other information are accurate. However, occasionally changes and errors do arise and we reserve the right to correct them in such circumstances. You must check the current price and all other information relating to the arrangements that you wish to book before your booking is confirmed.

 

A.Cancellation by you:

If you want to cancel your booking after we have confirmed it, you must immediately advise us in writing. We require your authority in writing before we can make any change and if it is received outside our Customer Service operating hours, it will only be effective from the next working day.

Since we and travel providers incur costs in cancelling your travel arrangements, such as for the flights which are non-refundable in all cases, we will ask you to pay cancellation charges per person on the scale shown below. Cancellation charges are calculated on the basis of the total cost payable by the person(s) cancelling, excluding credit/charge cards and amendment charges.

In the event of a cancellation of a booking secured by a low deposit, we reserve the right to collect the balance of the full deposit amount. You may be able to make a claim under your travel insurance policy if your cancellation falls within the conditions of the policy. Claims must be made directly to the insurance company concerned.

Cancellation charges are as follows which will include amendment fees additionally.

  1. More than 80 days – Deposit only (Including Amendment Fees)
  2. Between 45 and 80 days – 50% of total amount of holiday + 150 CAD as Amendment Fees
  3. Between 16 and 44 days - 75% of total amount of holiday +150 CAD as Amendment fees
  4. Less than 15 days 100% of total amount of holiday +150 CAD as Amendment fees

 

Note: In some cases, the deposit may be a higher amount to secure your arrangements, this will be non-refundable, and the charges will be added to the cancellation charges above

The cancellation charge detailed is calculated on the basis of the total cost payable by the person(s) cancelling excluding insurance premiums and amendment charges which are not refundable in the event of the person(s) to whom they apply cancelling.

If the reason for your cancellation is covered under the terms of your insurance policy, you may be able to reclaim these charges. We will deduct the cancellation charge(s) from any monies you have already paid to us.

 

 B. Changes by you:

 

Should you wish to make any changes to your confirmed holiday, you must notify us in writing as soon as possible. Whilst we will endeavour to assist, we cannot guarantee we will be able to meet any such requests.  A change of holiday dates will normally be treated as a cancellation of the original booking and rebooking in which case cancellation charges will apply. Changes may result in the recalculation of the holiday price where, for example, the basis on which the price of the original holiday was calculated has changed.

In the event we can meet your requested change, you will have to pay an administration charge of CAD 95 per person per change, plus any further costs we incur in making this alteration, together with all costs or charges imposed by any suppliers. You should be aware that these costs generally increase significantly the closer to the departure date that changes are made, and you should contact us as soon as possible. Please note that most airlines do not permit name changes for any reason after confirmation. If you wish to make a name change, this will be treated as a cancellation and re-booking. You will have to forfeit the amount you have already paid for your flight and pay the full, current cost of the flight again. Your ability to rebook will be subject to a seat being available for a new reservation. Where we and the travel supplier are unable to assist with making a requested change, and you do not wish to proceed with the original booking we will treat this as a cancellation by you.

Note: Certain arrangements in particular sums paid for flights or non-refundable travel services, may not be amended after they have been confirmed and any alteration or cancellation could incur a charge of up to 100% of that part of the arrangements in addition to the charges above.

If we cancel your booking

(i) We reserve the right to cancel your booking. We will not cancel less than 30 days before your departure date, except for unavoidable and extraordinary circumstances, or failure by you to pay the final balance.

(ii) Unavoidable and extraordinary circumstances means a situation beyond our control, the consequences of which could not have been avoided even if all reasonable measures had been taken. 

(iii) If your holiday is cancelled you can either have a refund of all monies paid or accept an alternative holiday of comparable standard from us if we offer one (we will refund any price difference if the alternative is of a lower value).

(iv) In the event a refund is paid to you, we will pay compensation as detailed below except where the cancellation is due to unavoidable and extraordinary circumstances (see definition above).

If we change your booking

a) It is a term of your booking that we are able to make changes to any aspect of your booking. If the change is insignificant, we will ensure that you are notified about it. Examples of insignificant changes include alteration of your outward/return flights by less than 12 hours, changes to aircraft type, change of accommodation to another of the same or higher standard, changes of carriers, change of value added benefits such as a romantic dinner.  

b) If we are constrained by circumstances beyond our control to alter significantly any of the main characteristics of the travel services that make up your package you will have the rights set out below:

i) We will contact you and you will have the choice of accepting the change or having a refund of all monies paid. You can also accept an alternative holiday, where we offer one (we will refund any price difference if the alternative is of a lower value). We will tell you the procedure for making your choice. Please read any notification of changes carefully and respond promptly as if you do not respond to us within the timescale given your booking may be cancelled.

 ii) If you choose to accept a refund we will pay compensation as detailed below except where the significant change is due to unavoidable and extraordinary circumstances, which means a situation beyond our control, the consequences of which could not have been avoided even if all reasonable measures had been taken.

Please Note: The compensation that we offer does not exclude you from claiming more if you are entitled to do so.

We clearly instruct all our travelers to have comprehensive Travel Insurance prior to travel. We recommend this is purchased along with your holiday for immediate coverage. Certain countries have a requirement for foreign visitors to have valid medical insurance on entry. We cannot be held responsible for denied entry if you are unable to provide details to authorities of insurance or denial of entry for any reason. If you choose travel without adequate insurance cover, we will not be liable for any losses howsoever arising, in respect of which insurance cover would otherwise have been available. You also acknowledge that without this coverage, there may be no way to recoup any losses, costs or expenses incurred. If you choose to travel without adequate coverage, we will not be liable for any of your losses howsoever arising, for which trip protection plan coverage would otherwise have been available.   

If you have any special requests, you must advise us at the time of booking (e.g. Diet, room location, a particular facility at a hotel etc.).Whilst we will endeavour to pass any reasonable requests on to the relevant Supplier, no guarantee that any request will be met can be given and we will have no liability to you if they are not. Failure to meet any special request will not be a breach of contract on our part unless the request has been specifically confirmed. We do not accept bookings that are conditional upon any special request being met.

Immunizations may be required to gain entry into certain destinations and/or to gain re-entry back into Canada. Recommended inoculations for travel may change and travellers should consult a local travel medical clinic for current recommendations before departure. It is each traveller’s responsibility to ensure all health entry requirements, obtain the recommended inoculations, take all recommended medication, and follow all medical advice in relation to your trip. The traveller is responsible for ensuring that they are up to date with all requirements in this matter. For information on Canadian requirements regarding provisions on immunizations, passports, visas, etc. please visit http://www.travel.gc.ca/ .It is recommended that travellers contact the destination country’s embassy in Canada with further questions before they depart.

Disinfection: Countries reserve the right to disinfect aircraft if there is a perceived threat to public health, agriculture or environment. The World Health Organization and the International Civil Aviation Organization have approved the following disinfection procedures: (1) spray the aircraft cabin with an aerosolized insecticide while passengers are on board or (2) treat the aircraft’s interior surfaces with a residual insecticide while passengers are not on board. Be sure to read the Terms and Conditions (or Rules and Regulations) of the suppliers delivering the services in your arrangements specifically if a traveller is pregnant or has another medical situation or condition. Different rules may apply to different tour operators, airlines, etc. and certain conditions are beyond the control of Travelodeal.com

Travelling While Pregnant:

In the event a traveller has entered into the 32ndweek of pregnancy, Travelodeal recommends that to carry a letter from traveller’s doctor, stating the pregnancy is uncomplicated and confirming the expected date of delivery. In this letter, the doctor should state that you are in good health, and that (in their opinion) there is no reason why you cannot fly. Travelodeal strongly recommends you contact the airline in advance of flying to confirm the regulations as outlined in their policy. Travelodeal is not responsible for either the traveller’s ability to be allowed to board or denied or for any health issues that may arise from travelling while pregnant.

Cruise lines will NOT accept travellers who have entered their 24thweek of pregnancy by the beginning of, or at any time during the cruise or cruise tour. A physician’s ‘Fit to Travel’ note is required prior to the sailing, stating how far along (in weeks) your pregnancy will be at the beginning of the cruise. Travelodeal recommends you visit the cruise line website prior to sailing to confirm the regulations as outlined in their policy.

Traveldoeal cannot be held responsible for any refusal of service due to pregnancy or any refunded amounts due to cancellation or trip interruption related to the said pregnancy.

 

ZIKA VIRUS UPDATE:

Canadian travellers visiting affected areas should help protect themselves against Zika virus by taking individual protective measures to prevent mosquito bites, including using insect repellent, protective clothing, mosquito nets, screened doors and windows. There is no vaccine or medication that protects against Zika virus infection. It is recommended that pregnant women and those considering becoming pregnant discuss their travel plans with their health care provider to assess their risk and consider postponing travel to areas where the Zika virus is circulating.

It is your responsibility to obtain information and to have in your possession all the required documentation and identification required for entry, departure and travel to each country or region you visit on your Holiday. This includes a valid passport and all travel documents required by the relevant governmental authorities including all visas, permits and certificates (including but not limited to vaccination or medical certificates) and insurance policies Most countries now require passports to be valid for at least 6 months after your return date. If your passport is in its final year, you should check with the Embassy of the country you are visiting. You accept full responsibility for obtaining all such documents, visas and permits prior to the start of the Holidays, and you are solely responsible for the full amount of costs incurred as a result of missing or defective documentation. You agree that you are responsible for the full amount of any loss or expense incurred by us that is a direct result of your failure to secure or be in possession of proper travel documentation.

It is strongly recommended that you use the Registration of Canadians Abroad service which provides government officials traveller’s contact information in preparation for an emergency (such as a natural disaster or civil unrest), instructions during emergencies, important changes or updates to the Travel Advice and Advisories for the country for which you registered, and more. Information on Canadian passport applications is available from the Government of Canada at  If a passport is damaged in any way, passengers may be denied boarding and will be responsible for all costs associated with a new passport and replacement travel arrangements. For assistance please contact the Government of Canada’s Passport Services at https://www.canada.ca/en/immigration-refugees-citizenship/services/canadian-passports/new-adult-passport.html .

Travelodeal accepts no liability if travellers are refused entry onto a flight or into any country due to failure to carry the correct and adequate passport, visa, or other travel documents required by the airline, authority, or country, including countries travellers may be transiting through. This includes all stops or transit made by the mode of transportation booked, even if not exiting the carrier (examples trains, planes, cruise ships etc.)

If you have a complaint about any of your arrangements, you must notify Travelodeal, via e-mail at admin@travelodeal.com or by phone at customer service contact number mentioned on the Travelodeal’s website. Any complaint against Travelodeal or third party supplier or in respect to the Trip Service must be promptly submitted within 2 days after the scheduled day of consummation of the product or service (e.g. check out date). Any complaint that is submitted after the 28 days period may be rejected, and the claimant will forfeit the right to any compensation/refund.

Travelodeal will forward all customer service issues to the appropriate third-party supplier (e.g. – suppliers delivering services in your arrangement). Travelodeal cannot be held responsible for services purchased but not received by a third-party supplier but as your retail travel agent, will work to help get a resolution on the customer’s behalf.

Except where otherwise expressly stated in these Booking Conditions we will not be liable or pay you compensation if our contractual obligations to you are affected by “unavoidable and extraordinary circumstances”, meaning any event beyond our control, the consequences of which could not have been avoided even if all reasonable measures had been taken. Examples include warfare and acts of terrorism (and threat thereof), civil strife, significant risks to human health such as the outbreak of serious disease including any mutation or variation of, and  the ongoing effects of, Covid-19 or SARs-COV2, or natural disasters such as floods, earthquakes or weather conditions which make it impossible to travel safely to the travel destination or remain at the travel destination, the act of any government or other national or local authority including port or river authorities, industrial dispute, lock closure, natural or nuclear disaster, fire, chemical or biological disaster, unavoidable technical problems with transport and all similar events outside our or the supplier(s) concerned’s control. 

Some countries may require travellers to undergo a health check prior to boarding/entry and present proof of a negative COVID-19 test. In the event that either an air operator, hotel/resort or cruise line observes any COVID-19 symptoms, the operator may refuse boarding or entry. The traveller may, if in destination, need to self-isolate for a period of 14 days or until a medical certificate is presented that confirms that the symptoms that the traveller is exhibiting are not related to the COVID-19 virus. The traveller will be responsible for all cost associated if they are required to stay beyond their original departure date due to COVID-19 reasons. More countries are adding requirements so please be sure to verify what is required prior to your departure.

Special note on the situation of COVID-19:In the event that the destination country of the trip requires the presentation of a PCR test or any other necessary requirement for the trip, the costs related to it will be borne by the client, as well as the responsibility of doing it within the time required by the destination of the trip. In the event that the client, once the trip has started, presents any symptoms related to COVID and that results in a modification of the contracted services, (e.g. overnight stay, hotel or flight changes), the extra costs will be borne by the clients and the same must subsequently be claimed from their insurer.

Our responsibilities differ according to what you have booked like in relation to bookings of ‘packages’ ,we accept responsibility as an “organizer” under the Package Regulations. Subject to these booking conditions, if we or our suppliers negligently perform or arrange the services which we are obliged to provide for you as set out on your confirmation, we will pay you reasonable compensation. Please note that it is your responsibility to show that we or our supplier(s) have been negligent, if you wish to make a claim against us. In relation to all other bookings which is not a package, we have a duty to select the suppliers of the services making up your booking with us with reasonable skill and care.

We will not be responsible or pay you compensation for any injury, illness, death, loss, damage, expense, cost or other claim of any description if it results from the act(s) and/or omission(s) of the person(s) affected; or from the act(s) and/or omission(s) of a third party unconnected with the provision of the services contracted for and which were unforeseeable or unavoidable,; or from unusual or unforeseeable circumstances beyond ours or our supplier(s) control, the consequences of which could not have been avoided even if all due care had been exercised; or from an event which either ourselves or suppliers could not, even with all due care, have foreseen or forestalled.

All baggage and personal effects are at all times and in all circumstances at the risk of the guided vacation/holiday participant. We recommend that passenger obtain baggage insurance. After return at the end of the guided vacation/holiday, if lost articles are found and returned to the owner, a service fee will be charged. 

We will not be responsible or pay you compensation for any of the travel services which do not form part of our agreement or where they are not advertised by us.

Any compensation that is payable will be calculated taking into consideration all relevant factors. It is a condition of our acceptance of liability under this clause that you notify any claim to ourselves and our supplier(s) strictly in accordance with the complaints procedure set out in these conditions; the extent to which ours or our employees’ or suppliers’ negligence affected the overall enjoyment of your arrangements; when making any payment, we are entitled to deduct any money which you have received or are entitled to receive from any transport provider or hotelier for the complaint or claim in question.

Please also note that where any payment is made, the person(s) receiving it (and their parent or guardian if under legal age) must also assign to us or our insurers any rights they may have to pursue any third party and must provide us and our insurers with all assistance we may reasonably require.

We have a liability to you for supplying the travel services except where they cannot be supplied or travel arrangements have been changed due to delays or other causes of whatever kind or nature beyond our direct control. In such circumstances, we will seek to supply comparable services, accommodations and travel arrangements and there shall be no refund in these circumstances. We do not own or operate any of the Travel Services.

The air carriers, accommodations, and other suppliers (including but not limited to trains, cruises, ferries, motor coaches, hotels, and restaurants) providing services are independent contractors and are not agents, employees, servants, or joint ventures of the Travelodeal.  All certificates and other travel documents for services issued by Travelodeal are subject to the terms and conditions specified by the carriers and suppliers and to the laws of the countries in which the services are supplied. Carriage by sea is subject to the Carrier’s Conditions of Carriage which are expressly incorporated into this contract, copies of which are available upon request. The released parties are not responsible for any criminal or other conduct by third parties, whether criminal, intentional, grossly negligent, negligent or otherwise.

Neither Travelodeal, its suppliers, partners, agents and/or employees shall be responsible or liable for cancellations, acts of other service providers, diversions or substitution of equipment or any act, variation, postponement, omission or default by air carriers, land carriers, hoteliers or hotels, transportation companies, or any other persons providing services or accommodations to travellers including any results thereof, such as changes in services, accommodations or facilities. Nor shall we be liable for loss or damage to baggage or property, or for injury, illness or death, or for any damages or claims whatsoever arising from loss, negligence or delay from the act, error, omission default or negligence of any person not its direct employee of them or under their exclusive control, including any act, error, omission, default, or negligence of any country, government or governmental authority, officer or employee. We shall not be liable for indirect, special or consequential damages

The right is reserved to withdraw any package or travel arrangements advertised on the Website and/or make such changes in the package or travel arrangements as may be found desirable for the convenience of the parties and the proper carrying out of package or travel arrangements.

If in our reasonable belief or opinion or in the reasonable belief or opinion of any person in authority, your behaviour is jeopardising the safety of aircraft, people or property therein or good order and discipline on board; or is causing or is likely to cause distress, danger, damage or annoyance to any third party or property, or to cause a delay or diversion to transportation, we reserve the right to terminate your arrangements immediately. In the event of such termination our responsibilities to you will cease and you will be required to leave your accommodation or other service immediately. We will have no further obligations to you and will not meet any expenses, costs or losses incurred as a result. You may also be required to pay for loss and/or damage caused by your actions directly to the applicable supplier prior to departure from the service. If you fail to do so, you will be responsible for meeting any claims and costs subsequently made against us as a result.

Travel documents including, without limitation, booking confirmations, are sent to you by electronic mail whenever possible. Paper documents may be sometimes necessary in which case the documents will be sent by priority mail. You may request paper documents instead of electronic documentation, in which case the passenger will pay the additional applicable charges.

It is the responsibility of the customer to examine all itineraries, tickets and vouchers at the time of receipt. If there is an error or omission, it is the sole responsibility of the customer to immediately notify provider of the problem. Failure to do so, will result in provider charging a fee or refusing to modify documents. If errors and omissions occur, we reserves the right to cancel the reservation and refund monies collected.

Flight times are not guaranteed and are subject to change. It is your responsibility to confirm your latest flight time with your carrier when your check-in prior to departure. Nonstop and single plane service are not guaranteed. International flights are subject to the respective foreign governments granting landing rights for the flights. If the air carrier cannot obtain these rights, the flight will be canceled and a full refund will be made to you automatically in the form of original payment. The air carrier and/or Travelodeal reserve the right to substitute other aircraft/airlines if necessary. We are not liable if there is any change to a departure or arrival time previously given to you or shown on your ticket.

Travelodeal does not accept responsibility for lost wages, missed vacation time or any other additional expenses incurred as a result of changes in flight times.

We recommend that all travellers purchase comprehensive Travel Insurance. Certain countries have a requirement for foreign visitors to have valid medical insurance on entry. We cannot be held responsible for denied entry if a traveller is unable to provide details to authorities of insurance or denial of entry for any reason.
